Driver’s License Clarifications

As of the 2022 legislative session, a driver’s eligibility statement is no longer necessary to verify legal school attendance for new drivers under age 18. However, a permit holder under the age of 18 must still maintain school enrollment and satisfactory progress. For homeschoolers, “school enrollment” simply means compliance with one of the homeschool exemptions under WV Code 18-8-1(c). A homeschooled applicant who has already graduated but is not yet 18 years old could be asked to show his or her diploma. 

Note: the online Driver’s Licensing Handbook incorrectly states that an eligibility statement is still required (page 5). Even so, we know of no DMV offices that are unaware of the 2022 change.
